The Challenge: A Judgment with No Teeth

Our client, a European manufacturing company (“Euro-Man”), had won a clear legal victory. They had obtained a court judgment from their home country’s commercial court for a significant sum of money against a Dubai-based company (“Dubai-Trader”) that had defaulted on a large supply contract.
However, the judgment was just a piece of paper. Dubai-Trader had no assets in Europe, so the judgment had no “teeth.” The only way for Euro-Man to actually recover their money was to have the European judgment legally recognized and enforced against Dubai-Trader’s assets in the UAE. They came to Fakher & Co for help, frustrated and unsure if they would ever see their money.

Our Strategy: Navigating the Path of Reciprocal Enforcement

The enforcement of foreign court judgments in the UAE is a complex area of law. It is not automatic. The UAE courts will only enforce a foreign judgment if certain strict conditions are met, primarily the principle of “reciprocity”—meaning a UAE court judgment would be treated in the same way in the foreign country.
Our dispute resolution team immediately developed a clear legal strategy:
1. Legal and Procedural Analysis: We first conducted a thorough analysis of the bilateral treaties between the UAE and the specific European country. We confirmed that a treaty for reciprocal enforcement of judgments was in place, which was the crucial first step.
2. Preparing the Case File: We worked with the client to assemble a complete and fully authenticated case file. This involved obtaining a certified copy of the foreign judgment and ensuring all documents were legally translated into Arabic and attested through the correct diplomatic channels (a process we managed for the client).
3. Filing an Enforcement Action: We filed a new case in the UAE courts. It is important to note that this was not a “retrial” of the original dispute. This was a specific type of case where we were asking the UAE court to recognize and ratify the foreign judgment.

The Argument in Court

In court, the lawyers for Dubai-Trader raised several arguments to try and block the enforcement, claiming that the European court had no jurisdiction and that the judgment violated UAE public policy.
Our team systematically dismantled these arguments. We demonstrated to the UAE judge that:
  • The European court did, in fact, have proper jurisdiction over the case according to the terms of the original contract.
  • The judgment was final and unappealable in its home country.
  • The judgment did not contradict any prior UAE court judgments or violate UAE public policy.

The Result: A Successful Enforcement and Recovery

The UAE Court of First Instance ruled in our client’s favor, issuing an order to recognize and enforce the European judgment. While Dubai-Trader attempted to appeal the decision, the Court of Appeal upheld the initial ruling.
Armed with the UAE court’s enforcement order, we were then able to take immediate action. We successfully obtained an attachment order against Dubai-Trader’s bank accounts in the UAE. Within a short period, the full amount of the judgment, plus our legal costs, was recovered and transferred to our client.
